Legal Proceedings Unfold in Kim Soo-Hyun’s Advertising Contract Dispute
On November 21, the Seoul Central District Court conducted its inaugural hearing for a lawsuit filed by cosmetics brand ‘A’ against renowned South Korean actor Kim Soo-Hyun. This legal action stems from accusations of a breach of contract related to the actor’s role as a brand ambassador.
Escalating Demands for Damages
Initially, the cosmetics company sought a lesser amount; however, it has since intensified its claims, now demanding a total of 2.86 billion Korean won (approximately $1.95 million) in damages. The dispute arises from a contract that was originally valid until August 2025, which the company cut short in March, citing significant allegations that hampered their ability to work together.
Background of the Dispute
The controversy ignited when allegations surfaced regarding a relationship between Kim Soo-Hyun and actress Kim Sae-Ron, specifically claiming that they dated while she was still a minor. Following these allegations, the brand felt it was necessary to terminate its agreement with the actor.
Claims from the Cosmetics Brand
In its legal documents, cosmetics brand ‘A’ asserts that Kim Soo-Hyun did not uphold the required standard of a respectable public image as stipulated in their contract, leading to considerable financial repercussions for the company. The brand justified its heightened demands by referencing specific contractual terms that mandate double the modeling fee as damages in case of a breach, alongside other incurred penalties.
Defense Argument Presented
During the hearing, Kim Soo-Hyun’s legal representation challenged the claims made by the cosmetics company. They argued that there is no specific requirement within the contract that mandated the actor to uphold a certain public image, thus denying the allegations of a breach. Additionally, they contested the timing of the alleged relationship, asserting that it only began after Kim Sae-Ron had reached adulthood and therefore does not warrant any legal liability. The defense maintained that without a proven breach of contract, the actor should not be held accountable for the claimed damages.
Industry Repercussions
The decision by brand ‘A’ to sever ties with Kim Soo-Hyun reflects a larger trend within the industry, as several other companies have similarly opted to end their partnerships with the actor in light of the recent scandal. Collectively, other advertisers and endorsement partners have initiated separate legal action, claiming damages totaling around 7.3 billion won (approximately $5 million).
