Google Responds to CMA Designation of Mobile Platform with Strategic Market Status
In a recent development, Google has officially addressed the UK’s Competition and Markets Authority’s (CMA) designation of its “Mobile Platform, ”which encompasses Android, the Play Store, Google Chrome, and the Blink engine, with Strategic Market Status (SMS).This designation was announced earlier today.
Understanding Strategic Market Status (SMS)
Strategic Market Status is a formal classification introduced under the Competition and Consumers Act 2024. This law, set to take effect on January 1, 2025, empowers the CMA to better regulate markets to ensure fair practices for both consumers and businesses alike. The UK government has pitched this new framework as a mechanism to “unlock opportunities for more innovation and economic growth”throughout the tech sector in the UK.
Concerns Over Market Power
The CMA’s decision followed extensive consultations with over 150 stakeholders. The authority concluded that both Google and Apple possess “substantial, entrenched market power and a position of strategic significance”within their respective mobile ecosystems. The CMA expressed concerns that such dominance is likely to persist despite advancements in artificial intelligence and other emerging technologies.
Google’s Defense and Market Dynamics
In response to the CMA’s designation, Google defended its marketplace by emphasizing that both Android and Chrome aim to foster “more choice, not less.”The tech giant highlighted the open-source nature of the Android operating system, which allows anyone to customize it at no cost. Additionally, Google pointed out that users can install apps from alternative app stores or directly from developers’ websites—an option that is often restricted on competing mobile platforms.
Statistics further support Google’s position, as the company revealed that over two-thirds of Android devices in the UK come preloaded with alternative app stores, while 70% of these devices have non-Chrome browsers installed. This data underscores a diverse mobile environment that challenges the critics’ perception of monopolistic practices.
Implications of SMS Designation
Notably, the CMA clarified that being designated with SMS is “not a finding of wrongdoing.”Instead, this status enables the regulator to impose targeted regulations aimed at maintaining a competitive market landscape.
CMA’s Broader Regulatory Actions
In related news, the CMA has recently intensified its scrutiny of the proposed merger between Getty Images and Shutterstock, two of the leading providers in the stock media industry. The authority has identified potential significant risks to competition, not just within the UK but globally, in the realm of editorial content supply.
