Google criticizes Europe’s DMA alongside Apple

Apple and Google Challenge the EU’s Digital Markets Act

Recently, Apple issued a detailed statement addressing the European Union’s (EU) Digital Markets Act (DMA), arguing that it ultimately leads to fewer options for consumers, diminishes the uniqueness of vendor offerings, and fosters an environment of unfair competition. Apple has raised concerns about App Store limitations, suggesting these regulations push iOS closer to the Android model.

Following Apple’s remarks, Google joined the conversation, advocating for a “reset”of the DMA. The tech giant articulated that while the DMA was intended to create a level playing field in the digital marketplace, it appears to be doing the opposite. Notably, this legislation is adversely affecting the European tourism sector. Google Search, which typically connects users directly to hotel and airline booking sites, is now required to direct traffic to intermediary platforms instead. This shift not only compromises the user experience but also increases costs for consumers, inadvertently favoring middle-man websites over the actual service providers. Furthermore, these regulations may expose customers to enhanced cybersecurity risks from third-party companies.

The Impact on Innovation and Compliance Challenges

Google highlighted that the DMA was purportedly instituted to spur innovation via greater interoperability; however, it has instead resulted in excessive bureaucracy and untested regulations, stifling its intended benefits. Echoing Apple’s sentiments, Google mentioned that the launch of new AI features intended for European users has been delayed by up to a year due to uncertainties around compliance with the DMA.

We have proactively made many changes to our products to comply with the DMA, including offering new opportunities like data portability tools for European businesses and developers. But we and other companies still face considerable uncertainty and unpredictability. This is compounded by overlapping rules from national regulators and cases before national courts that are increasingly undermining the DMA’s goal of creating harmonized, consistent rules across the EU.

Looking Ahead: Google’s Call for Consistent Enforcement

As a response to the challenges posed by the DMA, Google has called upon the European Commission (EC) to reassess the act. The company advocates for an enforcement strategy that prioritizes consumer interests, is based on factual evidence, and aligns with the original intent of fostering competition in the digital market.
