Former Intel Employee Sentenced for Trade Secret Theft
Varun Gupta, a former product marketing engineer at Intel, has been sentenced to two years’ probation for his involvement in the unauthorized transfer of confidential company documents to Microsoft, where he began working in early 2020. Gupta, who had a decade-long career at Intel, faced legal action after it was revealed that he had taken approximately 4, 000 sensitive files, including crucial pricing strategies and competitive analyses, when he transitioned to Microsoft.
Background and Legal Proceedings
In February 2021, just a year after joining Microsoft, Gupta was sued by Intel for transferring proprietary documentation. Following the lawsuit, he entered into a confidential settlement agreement with Intel. The investigation into his actions escalated when Intel executives became concerned that Gupta was leveraging Intel’s internal information to negotiate on behalf of Microsoft during contract discussions for processor purchases.

Sentencing Details
Recently, Gupta received a sentence from Judge Amy Baggio that was less severe than prosecution’s request for an eight-month prison term. The judge imposed two years of probation and a fine totaling $34, 472, citing Gupta’s prior settlement of $40, 000 in the civil lawsuit, as well as the personal repercussions he faced following his actions, including a tarnished reputation and the loss of his career in the tech industry.

In light of his legal troubles, Gupta has relocated to France, where he intends to start anew in the winemaking field. He is presently pursuing graduate studies in vineyard management—a significant career shift from his previous roles in technology. The judge noted his diminished standing in the industry as a contributing factor to the leniency of his sentence.
