The FBI affidavit made public on October 25, 2024, reveals that artist Lil Durk, whose real name is Durk Devontay Banks, faces charges for conspiracy to commit murder-for-hire. Several associates from his rap collective, OTF, have also been detained.
Durk was apprehended on the evening of October 24 on federal allegations that he financed the attempted revenge killing of fellow rapper Quando Rondo in 2022. Tragically, the attack led to the death of Durk’s cousin instead of Rondo at a gas station.
Innovation surfaced when celebrity lawyer Bradford M. Cohen discussed the potential defenses Lil Durk has regarding the conspiracy charge during a podcast on Law&Crime’s YouTube channel. On the October 29 segment, he remarked,
“Regarding Durk Banks, I’ve come across a single text stating, ‘Don’t associate my name with any flights they’re taking.’ While that text isn’t ideal, can we assume it’s the only evidence? It doesn’t establish anything definitively by itself and remains circumstantial.”
Currently, the primary piece of alleged incriminating evidence against Durk appears to be this text message expressing his desire to distance himself from his OTF associates. Bradford Cohen emphasized that while it reflects poorly, further proof is necessary to substantiate the conspiracy charges.
Lawyer Bradford Cohen Shares Insights on Lil Durk’s Case
The rapper from Chicago is currently linked to a conspiracy involving murder-for-hire. Legal analyst Jesse Weber from Law&Crime examined the indictment and charges against Lil Durk along with other alleged co-conspirators, later inviting Bradford Cohen on the show to delve deeper into the discussion.
“I believe Durk’s defense remains viable…. There are certain gaps in understanding how deeply he was engaged in this supposed conspiracy. The others involved appear more compromised with plane tickets, car rentals, and recordings. Their representation will likely face a tougher challenge because of such direct evidence.”
During the podcast, Cohen elaborated on the lack of substantial evidence against Durk compared to his co-defendants, who possess undeniable proof against them, such as recorded footage and travel documents, complicating their legal situations.
“There are numerous methods for law enforcement these days to capture individuals engaging in this type of crime using cell phone records and GPS data. There will be cross-references showing phone locations together at certain times, rental contracts, and surveillance footage.”
Cohen elaborated on the various ways authorities can gather evidence, mentioning,
“Often, you find that federal agencies obtain footage from red light cameras and similar sources. When I want access to footage that could benefit my client, they often respond, ‘Sorry, we don’t keep that.’ Yet, somehow, federal investigators have access to recordings from local cameras or even from people nearby.”
This insightful interview was conducted just five days following Lil Durk’s arrest. According to the Justice Department, he is implicated in a shooting incident that occurred at a gas station close to the Beverly Center in Los Angeles back in August 2022.
U.S. Attorney Martin Estrada stated that,
“Mr. Banks is accused of orchestrating a calculated murder that resulted in the death of a rival’s family member. Moreover, this shooting took place in a public area, endangering numerous individuals nearby.”
Estrada further expressed that this act of gun violence has adversely impacted the community, emphasizing a strict “zero tolerance”policy for such violent crimes.
Lil Durk was taken into custody late Thursday near Miami International Airport. He made his first appearance at the U.S. District Court for the Southern District of Florida on the afternoon of October 25, and remains in federal custody. His arraignment is expected to occur in the coming weeks in a Los Angeles federal court.
