China has initiated an antitrust investigation into NVIDIA, alleging breaches of the country’s anti-monopoly regulations linked to a major acquisition completed in 2020.
China Joins the US and France in Regulatory Scrutiny of NVIDIA’s 2020 Acquisition
In a development that highlights the ongoing tensions in global trade relations, NVIDIA, often referred to as “Team Green,”now faces regulatory challenges from both the United States and China. Recently, the U.S. Department of Justice (DoJ) commenced an investigation into possible antitrust violations related to NVIDIA’s AI sector. This scrutiny underscores the difficulties the company faces amid rising regulatory pressures internationally.
According to reports from Chinese media, the State Administration for Market Regulation (SAMR) has opened a formal investigation centered on NVIDIA’s acquisition of Mellanox Technologies, an Israeli chip manufacturer, which was completed four years ago. This acquisition was initially approved on the condition that NVIDIA would not engage in practices that would disadvantage Chinese companies.
As part of the acquisition terms, NVIDIA was required to inform its competitors about any new product launches at least 90 days in advance, ensuring fair competition in the market. Additionally, it needed to ensure that its products would be compatible with those of local Chinese chip manufacturers to prevent any monopolistic practices. Although details regarding the specific nature of the ongoing investigation have yet to be disclosed, the situation raises significant concerns for NVIDIA.
The impact of this news is already evident in the stock market, with NVIDIA shares dropping by 2% in pre-market trading, hinting at a shift in investor sentiment. Analysts suggest that these regulatory actions may be a retaliation against U.S. trade policies designed to impede China’s advancements in artificial intelligence. Despite NVIDIA’s efforts to comply with local standards by offering “China-compliant”technologies, the restrictions imposed by the U.S. have severely hampered both NVIDIA’s and China’s progress in the rapidly evolving AI landscape.
As this antitrust investigation unfolds, it remains to be seen what implications it will have for NVIDIA’s global operations. What is clear, however, is that the company is currently navigating a complex web of regulatory challenges worldwide.
